Deliveries, Services, and Offers
The deliveries, services, and offers from Lukinger GmbH are exclusively based on these terms and conditions. By ordering the goods or services, the terms are considered accepted. Any general purchasing terms of the buyer are hereby rejected. Deviations from these terms and conditions must be confirmed in writing.
Offer and Contract
The offers from Lukinger GmbH in price lists and advertisements are non-binding. Order confirmations are only issued upon explicit request. The information in our sales documents (drawings, illustrations, dimensions, weights, and other services) are to be understood as approximate values and do not represent any guarantee of properties. We are released from the obligation to deliver if a buyer exceeds their credit limit.
Prices
The prices stated in our order confirmation are decisive. These are fixed at the time of the order for in-stock items. Unless otherwise agreed, prices are inclusive of statutory VAT and exclusive of transport costs.
Delivery and Service Time
Delivery dates and deadlines are non-binding unless otherwise agreed in writing. Stipulations regarding specific delivery times and dates by Lukinger GmbH are subject to the correct and timely supply of Lukinger GmbH by third parties. In the case of a pre-sale where customers pay in advance to secure LUKE, delivery is planned for June 2026.
Delivery
For pre-orders in the pre-sale, customers are informed that delivery of LUKE is planned from June 2026. Customers pay in advance to secure LUKE, and delivery is scheduled for June 2026 (subject to change).
Warranty
The warranty is provided in accordance with the following provisions and lasts 1 year unless otherwise expressly agreed in writing. The warranty period begins on the delivery date.
If our operating or maintenance instructions are not followed, changes are made, parts are replaced, or consumables used that do not meet original specifications, all warranty claims are void if the defect is due to such actions. This also applies to defects resulting from improper use, storage, or handling of the device, unauthorized intervention, or opening of the device.
Minor deviations from guaranteed properties do not constitute warranty rights. Liability for normal wear and tear, as well as consumables or accessories, is excluded. Warranty claims against Lukinger GmbH are only available to the direct purchaser and are non-transferable.
Return Policy
For returns, we require that the defective part or device be sent or delivered to Lukinger GmbH for repair with:
A complete and detailed error/defect description & a copy of the invoice on which the device was delivered.
Returns of products require prior approval from Lukinger GmbH and are at the customer's cost and risk. Lukinger GmbH will not accept returns sent without postage paid. For justified returns, Lukinger GmbH will refund the shipping costs. Returns due to defects are subject to legal regulations.
Payment
If the customer does not fulfill their payment obligations in full or in part, all outstanding amounts owed to Luke AG under any title become immediately due (in the case of prepayment within 8 calendar days of the first reminder), and Lukinger GmbH can demand these amounts immediately and halt further deliveries of products.
Reminder fees:
- 2nd reminder: EUR 5
- 3rd reminder: EUR 20
In the case of unsuccessful reminders, the outstanding amounts may be assigned to a collection agency. In such a case, an annual interest rate of up to 15% on the owed invoice amount can be charged from the due date. The collection agency will assert the outstanding amounts in its own name and at its own expense and may charge additional processing fees.
Limited Liability
Claims for damages due to impossibility of performance, breach of contract, culpability during contract conclusion, or tort are excluded against us and our vicarious agents, unless intentional or grossly negligent conduct is involved.
Lukinger GmbH is a startup, and the offered product is still in development. This phase naturally involves certain risks, especially during the pre-sale. Customers should be aware of these risks and make their decisions carefully. No liability is accepted for consequential damages arising from the use of the products or for possible delays or changes resulting from the development process.
Privacy Policy
Lukinger GmbH is entitled to process the data regarding the business relationship or related to it, received from the buyer, whether from the buyer directly or from third parties, in accordance with the General Data Protection Regulation (GDPR) of the European Union and the Swiss Federal Data Protection Act (FADP). Personal customer data is treated confidentially and only shared with third parties in the context of a credit check.
Pre-sale Terms
The pre-sale of products by Lukinger GmbH is conducted according to the conditions and procedures described below. Customers are asked to carefully read these conditions to avoid misunderstandings and ambiguities.
1. Product Availability and Order
During the pre-sale, we offer selected products for purchase before they are regularly available on the market. Customers can pre-order these products by placing a binding order and paying the full purchase price in advance. The availability of the products and delivery times may differ from the regular conditions and depend on various factors such as production capacity, supply chains, and market demand.
2. Delivery
The delivery of pre-ordered products will be made in the order in which the orders are received. Estimated delivery dates will be provided during the pre-sale but may vary due to production or delivery delays. Lukinger GmbH will inform customers of such delays and offer them the option to cancel the order and have the deposit or full purchase price refunded if the delay is unreasonable.
3. Cancellation and Refund
Customers can cancel their pre-sale order at any time before the product is shipped. In this case, the deposit or full purchase price will be refunded. After shipment, the regular return rights and conditions apply.
4. Unforeseen Scenarios
In the event of Lukinger GmbH's insolvency, all claims will be processed according to legal provisions and in coordination with the insolvency administrator. Any remaining funds after settling all claims will be proportionally refunded to pre-sale customers who have not yet received their products.
5. Communication and Updates
Lukinger GmbH will regularly update customers about the pre-sale, production, and expected delivery dates via email, the website, or other communication channels. Customers are responsible for keeping their contact details up to date.
6. Liability Disclaimer
Lukinger GmbH is not liable for delays or inconveniences caused by force majeure, unforeseen production problems, or other circumstances beyond the company's control. Customers will be informed of such situations and, if necessary, given the option to cancel their order and receive a refund.
7. Changes to the Terms
Lukinger GmbH reserves the right to change the terms of the pre-sale at any time at its discretion. Customers will be informed of such changes and can cancel their order if they disagree with the new terms.
8. Applicable Law and Jurisdiction
German law applies to the pre-sale and related rights and obligations, excluding provisions of international private law. The jurisdiction for disputes arising from or related to the pre-sale is the seat of Lukinger GmbH.

Final Provisions
Should any provision of these terms be invalid, the validity of the remaining provisions shall not be affected. Instead of the invalid provision, a valid one shall be agreed upon, which comes closest to the economic purpose of the invalid provision.
